Infractions Against Rules on General Behavior

This section covers policies on maintaining professionalism, respect, and proper conduct in the workplace.

6.01 – DISORDERLY CONDUCT OR HORSEPLAY

Disorderly conduct or horseplay during working hours or inside Company premises

6.02 – SHOWING OR EXHIBITING PORNOGRAPHIC MATERIALS

done whether in or outside of the Company's network

6.03 – ACTS OF DISCOURTESY TO STOCKHOLDERS OR BOARD MEMBERS OR SUPERIORS

Acts of discourtesy to stockholders or Board Members or Superiors Acts of discourtesy to stockholders, company officers, business associates, customers or visitors

6.04 – ENTERING COMPANY PREMISES, OR ANY OF ITS PLACES OF JURISDICTION

Entering Company premises, or any of its places of jurisdiction, under the influence of liquor or alcoholic drink, or in a drunken condition; or drinking liquor or alcoholic drink within Company premises, or any of its places of jurisdiction

1st offense - 1-3 days suspension

6.4.1 – ENTERING COMPANY PREMISES, OR ANY OF ITS PLACES OF JURISDICTION, UNDER THE INFLUENCE OF ILLEGAL DRUGS

within Company premises, or any of its places of jurisdiction

6.05 – KNOWINGLY AND WILLFULLY ALLOWING TO BE RELIEVED BY AN EMPLOYEE WHO IS UNDER THE INFLUENCE OF DRUGS OR ALCOHOL

6.06 – DOING IMMORAL ACTS WITHIN COMPANY PREMISES OR ILLICIT RELATIONSHIPS

Doing immoral acts within Company premises or any of its places of jurisdiction; or entering into an illicit or immoral relationship with a co-employee, client, supplier or any business associate of the Company

6.07 – ANY ACT CONSTITUTING THREAT, VERBAL ASSAULT, PROVOCATION 

Any act constituting threat, verbal assault, provocation, intimidation, coercion or harassment against any employee; or in a manner unduly interfering with or obstructing Company operations or other employees from performing their work while within Company premises

1st offense - Termination

6.08 – PARTICIPATING IN HEATED AND LOUD ARGUMENT

Participating in heated and loud argument, discussion or debate during working hours and/or within Company premises or any place within its jurisdiction

1st offense - 1-3 days suspension
2nd offense - Termination

6.09 – USING OR UTTERING LEWD, RUDE OR INSULTING LANGUAGE DURING OFFICE HOURS

Using or uttering lewd, rude or insulting language during office hours and/or within Company premises, or engaging or offering to engage in immoral or unethical practices, goods and services to employees within Company premises

1st offense - 1-3 days suspension
2nd offense - Termination

6.10 -MISCONDUCT DURING WORKING HOURS

Misconduct during working hours, or within company- sponsored activities or affairs, or within Company premises or any place within its jurisdiction

1st offense - written warning
2nd offense - 1-3 days suspension
3rd offense - 3-5 days suspension
4th offense - Termination

6.11 – RUMOR-MONGERING, OR DISCLOSURE OF CO-EMPLOYEE’S PERSONAL AFFAIRS

Rumor-mongering, or disclosure of co-employee's personal affairs to others, distortion of fact(s) in a way that would discredit or embarrass another employee in all forms and modes of communication including social media

1st offense - written warning
2nd offense - 1-3 days suspension
3rd offense - 3-5 days suspension
4th offense - Termination

6.12 -THREATENING OR PROVOKING TO A FIGHT

Threatening or provoking to a fight or fighting another employee within Company premises, or outside Company premises but for work-related reasons

3rd offense - 3-5 days suspension
4th offense - Termination

There is actual physical fighting fighting:
1st offense - 1-3 days suspension

6.13 – STEALING, HIDING OR INTENTIONALLY MISPLACING

Stealing, hiding or intentionally misplacing without valid reason another co-employee's property within Company premises, at the job site or at any place of jurisdiction

1st offense - 1-3 days suspension
2nd offense - Termination

6.14 – ASSISTING AND/OR ENCOURAGING NON-EMPLOYEE (THIRD PARTY) TO HARM

Assisting and/or encouraging non-employee (third party) to harm, threaten, and/or physically attack a co-employee for reasons which are work-related

Encouraging:
1st offense - 1-3 days suspension
2nd offense - Termination

6.15 – UNAUTHORIZED DISCHARGING OF WORK OTHER

Unauthorized discharging of work other than the assigned work or task. Offense may lead to Grave Offense depending on the damage caused

6.16 – ANY ATTEMPT TO PERSONALLY INFLICT OR CAUSE BODILY PAIN, HARM, OR INJURY UPON ANOTHER, OR HAVE IN FACT INFLICTED OR CAUSED SAID INJURIES INSIDE THE COMPANY PREMISES OR WITHIN ITS IMMEDIATE VICINITY, WHETHER ALONE OR THROUGH THE USE OF FRIENDS, OR PERSONS NOT CONNECTED WITH THE COMPANY

1st offense - Termination

6.17 – ANY ACT OF VIOLENCE, COERCION, THREAT, INTIMIDATION OR ASSAULT AGAINST THE PERSON OR NAME OF A COMPANY OFFICIAL OR REPRESENTATIVE WITH THE INTENTION OF CAUSING DISGRACE, HARM OR BODY INJURY

1st offense - Termination

6.18 – ANY ACT OF VIOLENCE, COERCION, THREAT, INTIMIDATION OR ASSAULT UPON ANY OTHER PERSON OR ANY SUCH ACT WHICH CONSTITUTES THE COMMISSION OF A CRIME IRRESPECTIVE OF TIME AND PLACE

6.19 – BRINGING IN OR CARRYING FIREARMS, EXPLOSIVES, INFLAMMABLE MATERIALS AND OTHER DEADLY WEAPONS, SUCH AS BOLOS, ICE PICKS, ETC., INSIDE COMPANY PREMISES

6.20 – PROHIBITED DRUGS

Pushing, selling, using, or possessing prohibited drugs or substitutes within Company premises

6.21-CONVICTION OF CRIME

Conviction of a crime involving moral turpitude and crimes, which, by its nature and consequences, adversely affects the employee's performance or qualifications to remain an employee

6.22 – POSTING OF UNAUTHORIZED MATERIALS ON THE BULLETIN BOARD AND/OR UNAUTHORIZED REMOVAL OF OFFICIALLY POSTED NOTICES, MEMORANDUM OR ANNOUNCEMENTS

1st offense - 1-3 days suspension
2nd offense - 3-5 days suspension
3rd offense - Termination

6.23 – DAMAGING OR ENDAGERING COMPANY INTEREST(S) BY STEALING FROM, OR UTTERING WORDS OR MAKING GESTURES THAT ARE INSULTING OR GROSSLY DISRESPECTFUL AND/OR DISCOURTEOUS TO CLIENT(S), GUEST(S), VISITOR(S), OR FRIEND(S), WHILE ON DUTY OR WITHIN COMPANY PREMISES

1st offense - Termination

6.24 – DELIBERATE HINDERING, HOLDING BACK, LIMITING, OR SLOWING DOWN WORK AND/OR PRODUCTION AND/OR SALES ACTIVITY, MASS LEAVE, SIT-
DOWN, RIOT, OR SIMILAR DISRUPTIVE ACTIVITIES, OR INCITING, INTIMIDATING, THREATENING, INDUCING, CONVINCING OR COERCING OTHER EMPLOYEE(S) TO DO SO

6.25-GROSS INEFFICIENCY OR CONTINUING UNSATISFACTORY PERFORMANCE OF THE EMPLOYEE

6.26 – VIOLATION OF NON- FRATERNIZATION POLICY. THIS MAY LEAD TO TERMINAL OFFENSE WHEN CONTINUED NON- COMPLIANCE TO THE RULE POSTS CRITICAL/SENSATIONAL ISSUES IN THE COMPANY. PROHIBIT ROMANTIC RELATIONSHIPS BETWEEN A MANAGER AND A REPORTING STAFF MEMBER; PROHIBIT DATING RELATIONSHIPS BETWEEN EMPLOYEES REGARDLESS OF THE REPORTING RELATIONSHIP OR DEPARTMENT. THE FRATERNIZATION THAT IS PROHIBITED BY THIS POLICY INCLUDES DATING, ROMANTIC INVOLVEMENT, AND SEXUAL RELATIONS; CLOSE FRIENDSHIPS ARE DISCOURAGED IN ANY REPORTING RELATIONSHIP

6.29 – UNAUTHORIZED POSSESSION OR BRINGING IN OF FIREARMS, EXPLOSIVE OR ANY DEADLY WEAPON INSIDE COMPANY PREMISES, OR JOBSITE OR ITS PLACE OF JURISDICTION

6.34 – UTTERING MALICIOUS WORDS, DOING ACTS AND/OR MAKING GESTURES TO A SUPERIOR
